Scope
These Terms and Conditions ("Terms") govern all sales of paint, decorating tools, and paint-mixing/tinting services by The Decorator's Cupboard ("we", "us", "our") to any customer ("you", "the Customer"), whether purchased in-store, online, or by phone. By placing an order, you agree to be bound by these Terms.

1. Definitions
- "Goods" means paint, primers, coatings, brushes, rollers, and any other decorating products or tools we supply.
- "Mixing Service" means our in-store or online paint tinting/colour-matching service, including custom mixes to a specified colour code, swatch, or sample.
- "Order" means a request to purchase Goods and/or the Mixing Service, however placed.
2. Orders and Acceptance
- All Orders are subject to acceptance by us. We may decline or cancel an Order at our discretion, for example where an item is out of stock, mispriced, or we suspect fraud.
- A contract is formed only once we confirm acceptance of your Order (by email, receipt, or dispatch of Goods), not when you submit it.
- Product descriptions, colours, and images (including on our website) are as accurate as reasonably possible, but screen and print representations of colour may differ from the actual product. We recommend testing a sample before committing to a full order.
3. Pricing and Payment
- All prices are as stated at the time of Order and include any applicable taxes unless stated otherwise.
- We reserve the right to correct genuine pricing errors before an Order is dispatched or the Mixing Service is carried out, and will notify you before proceeding.
- Payment is required in full at the time of Order unless a trade account or other credit arrangement has been agreed with us in writing.
- For trade or business accounts, invoices are payable within the period stated on the invoice. Late payment may incur interest and/or suspension of further supply.
4. The Paint Mixing Service
- We will use reasonable skill and care to match a colour to the specification, code, or sample you provide. However, exact colour matching cannot be guaranteed, particularly when matching from a physical sample, a faded surface, a photograph, or a competitor's product.
- Colour can appear different depending on the base paint, the surface, lighting, sheen/finish, and the number of coats applied. We strongly recommend testing a small sample area and allowing it to dry fully before applying to the whole surface.
- Once paint has been mixed or tinted to your specification, it is made to order. Mixed paint cannot be resold as stock and is therefore non-returnable and non-refundable, except where it is faulty or was mixed incorrectly against the specification you provided (see Section 6).
- It is your responsibility to check the mixed colour and quantity against your requirements before leaving the store or before it is dispatched, wherever reasonably practicable.
- We are not responsible for colour variation between separate mixing batches. Where a project requires multiple tins of the same colour, we recommend ordering sufficient quantity in a single batch.
5. Delivery
- Delivery timescales given at the point of Order are estimates only and are not guaranteed.
- Risk in the Goods passes to you on delivery, or on collection if you collect from our premises.
- You are responsible for checking your Order on receipt and notifying us promptly of any shortage, damage, or discrepancy.
6. Faulty, Damaged, or Incorrect Goods
- If Goods are faulty, damaged in transit, or do not match the specification you provided for a mixed order, please contact us as soon as reasonably possible with details and, where applicable, photographs.
- Where we agree that Goods are faulty or a mixed colour does not match the agreed specification, we will offer, at our discretion, a re-mix, replacement, or refund.
- This section does not affect any statutory rights you may have as a consumer, which take priority over any conflicting term in these Terms.
7. Returns (Non-Mixed / Stock Goods)
- Unopened, unused stock Goods in their original packaging may be returned within 14 days of purchase with proof of purchase, for a refund or exchange, unless faulty (see Section 6).
- Custom-mixed or tinted paint, cut-to-size materials, and special-order items are excluded from this returns policy except where faulty, as set out in Section 6.
- We may deduct a reasonable amount from any refund for goods returned in a used, damaged, or incomplete condition, where this is due to handling beyond what is necessary to inspect them.
8. Product Use and Advice
- Any advice we give on suitability, coverage, application, or drying times is given in good faith based on the information you provide, but the manufacturer's instructions and safety data for the specific product always take precedence.
- You are responsible for ensuring the product is suitable for your intended surface and use, including any necessary preparation, primer, ventilation, and safety precautions.
- Coverage figures quoted are estimates only; actual coverage depends on the surface, application method, and number of coats.
9. Liability
- We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded or limited.
- Subject to clause 25, our total liability to you for any claim arising from an Order is limited to the price paid for the Goods or Mixing Service giving rise to the claim.
- We are not liable for indirect or consequential losses, including loss of time, loss of use of a room or building, or costs of redecoration arising from a colour or product not being as expected, except where this results from our negligence or breach of these Terms.
10. Gift Cards, Vouchers, and Promotions
- Gift cards and vouchers issued by us are not redeemable for cash and cannot be used in conjunction with other offers unless stated.
- Promotional pricing is valid only for the period stated and may be withdrawn or amended at any time before an Order is accepted.
11. Trade Accounts
- Trade account terms, credit limits, and payment periods are agreed separately in writing and take precedence over this section in the event of conflict.
- We reserve the right to withdraw or suspend trade credit terms at any time.

12. Privacy
We collect and use personal information you provide when placing an Order in accordance with our Privacy Policy, available on request or on our website.
13. General
- These Terms, together with your Order confirmation, form the entire agreement between us in relation to that Order.
- If any part of these Terms is found to be unenforceable, the remainder will continue to apply.
- We may update these Terms from time to time. The version in force at the time you place an Order will apply to that Order.
- These Terms are governed by the laws of England and Wales, and the courts of England and Wales will have exclusive jurisdiction over any dispute, unless otherwise required by applicable consumer protection law.
