Privacy Policy

The Decorator's Cupboard is an independent paint and decorating merchant at 14 Church Street, Ilfracombe, North Devon, EX34 8HB. We are the data controller for the personal information described in this policy.

This policy explains what we collect, why we collect it, how long we keep it, and the rights you have under the UK GDPR and the Data Protection Act 2018. It covers our website, our shop, and orders placed with us by phone or in person.

We only collect what we need to serve you. Depending on how you deal with us, that may include:

• Enquiry details — your name, business or trade name, phone number, email address and the message you send us through our enquiry form or by email.
• Order details — what you bought or asked us to mix, colour codes and specifications, quantities, delivery or collection address, and your order history.
• Payment information — the amount, date and method of payment. Card payments are processed by our payment provider; we never see or store your full card number.
• Trade account information — business name and address, company or VAT number, the names of authorised buyers, agreed credit limit and payment terms, and the outcome of any credit or identity check we carry out as part of your application.
• Correspondence — notes of conversations, quotes, complaints and warranty or returns claims, so we can pick up where we left off.
• Website information — basic technical data such as pages visited, handled as described in our Cookie Policy.

We do not knowingly collect information from children, and we do not collect special category data (such as health or biometric information).

• To respond to your enquiry — on the basis of our legitimate interest in answering people who contact us, or steps taken at your request before entering a contract.
• To fulfil your order — mixing paint to your specification, supplying goods, arranging delivery or collection, and handling returns. Lawful basis: performance of our contract with you.
• To set up and run a trade account — including credit and identity checks, invoicing and credit control. Lawful basis: performance of a contract, and our legitimate interest in managing credit risk.
• To keep proper business records — sales, VAT and accounting records. Lawful basis: compliance with our legal obligations.
• To keep in touch about offers — only where you have asked us to. Lawful basis: your consent, which you can withdraw at any time.

We do not sell your information, and we do not share it for anyone else's marketing. We share it only where it is necessary to provide what you have asked for, with:

• our payment providers, to take and reconcile payments;
• delivery partners, where your order is being delivered rather than collected;
• suppliers and manufacturers, where a special order, warranty claim or technical query has to be passed on;
• credit reference and fraud prevention agencies, where you apply for a trade account on credit — such searches may be recorded against your business;
• our accountant, IT and website providers, who act on our instructions and are bound to keep your information confidential;
• a regulator, or another party, where the law requires it.

Where a provider stores information outside the UK, we make sure appropriate safeguards are in place, such as UK adequacy regulations or standard contractual clauses.

• Enquiries that do not lead to an order: up to 12 months.
• Order, colour-mix and delivery records: up to 6 years, so we can re-mix a colour, honour a warranty, or deal with a claim.
• Accounting, VAT and invoice records: 6 years after the end of the relevant financial year, as required by HMRC.
• Trade account records: for the life of the account and 6 years after it closes.
• Marketing consents: until you withdraw them.

When we no longer need your information, we securely delete or destroy it.

We use appropriate technical and organisational measures to protect your information, including restricted access, password-protected systems and secure disposal of paper records. Only people who need your details to do their job can see them.

Under UK data protection law you have the right to:

• ask for a copy of the personal information we hold about you;
• have inaccurate information corrected;
• ask us to delete information we no longer need;
• ask us to restrict how we use your information, or object to us using it on the basis of legitimate interests;
• receive certain information in a portable format;
• withdraw consent at any time, where we rely on consent;
• opt out of marketing at any time, using the unsubscribe link or by telling us.

If you are unhappy with how we have handled your information, please tell us first so we can put it right. You also have the right to complain to the Information Commissioner's Office, the UK supervisory authority, at ico.org.uk.

We may update this policy from time to time. The version published here is the one in force, and the date it was last updated is shown at the top of this page. Orders are also subject to our Terms & Conditions of Sale.
